Privacy Policy and Terms and Conditions for PyGPT Software


Interpretation and Definitions

Interpretation

Words with the first letter capitalized have specific meanings defined under these conditions. These definitions apply regardless of whether the terms appear in singular or plural form.

Definitions

For the purposes of this Privacy Policy and Terms and Conditions:

  • "Author" refers to the creator(s) of PyGPT, also referred to as "We," "Us," or "Our" in this document.
  • "App" or "Application" means the PyGPT software application.
  • "You" or "User" means any individual or entity using the App or website.
  • "Provider" means a third-party AI, API, cloud, model, search, or other service used or configured through the App.

Disclaimer

General Information

Information and content provided through the App are for general purposes only. The Author assumes no responsibility for errors, omissions, inaccuracies, or outdated information contained in responses generated by AI models or other external services.

AI-Generated Content

Responses generated by artificial intelligence models may be inaccurate, incomplete, misleading, or inappropriate for a particular purpose. You are responsible for verifying important information before relying on it, especially in professional, financial, legal, medical, security-related, or other sensitive contexts.

Warranty and Liability

The App is provided "as is," without warranty of any kind, express or implied. To the maximum extent permitted by applicable law, the Author shall not be liable for any direct, indirect, incidental, special, consequential, or other damages arising from the use of, or inability to use, the App.

Age Restrictions

The App is intended for users who are at least 13 years old. Individual Providers may impose different or additional age requirements. You are responsible for complying with the terms and age requirements applicable to the services and Providers you use.

The App and website may contain links to third-party websites and services that are not operated or controlled by the Author. We are not responsible for the content, availability, security, privacy practices, or policies of third-party websites or services.

Errors and Omissions

Information provided through the App should not be relied upon as the sole basis for making important decisions without consulting appropriate primary, authoritative, or otherwise reliable sources.

Use at Your Own Risk

The App and information made available through it are provided without guarantees of completeness, accuracy, reliability, availability, or usefulness. You use the App, its tools, integrations, generated content, and external services at your own risk.


API, Token and Usage Costs

PyGPT can connect to multiple AI and service Providers, including but not limited to OpenAI, Anthropic, Google, xAI, Perplexity, Hugging Face, local model providers, and other services configured by the User.

API usage, token consumption, quotas, rate limits, subscription requirements, and billing rules are determined independently by each Provider. PyGPT does not control the pricing, billing, token calculation, usage limits, or account policies of third-party Providers.

Certain App features, plugins, agents, tools, attachments, multimodal requests, retries, background operations, or multi-step tasks may result in additional API requests and therefore additional token usage or other charges.

You are responsible for monitoring your API usage and any associated costs. Always check the usage dashboard, billing information, pricing documentation, and terms provided by the Provider whose service you are using.


Privacy of Your Data

Local Data and Data Handling

PyGPT is a desktop application and stores its application data and configuration locally unless a particular feature, integration, or Provider requires data to be transmitted to an external service.

The Author does not receive your conversation content, prompts, generated responses, files, or API keys merely because you use the App. Limited technical information may be transmitted when required for features such as version checks, updates, or other explicitly enabled online functionality.

Third-Party AI Providers and External Services

PyGPT acts as a client for third-party AI models, APIs, and other external services. When you select or configure an external Provider, data necessary to perform your request may be transmitted to that Provider.

Depending on the feature being used, transmitted data may include prompts, conversation context, instructions, attachments, images, audio, files, tool inputs and outputs, or other content required to process your request.

The processing, storage, retention, logging, use, and possible use for service improvement or model training of data sent to a third-party Provider are governed by that Provider's own privacy policy, terms of service, API terms, data retention rules, and account settings.

Different Providers may apply different rules, and those rules may also differ between consumer services, commercial services, enterprise products, and APIs. Before using a Provider through PyGPT, you should review the current privacy policy, terms of service, data usage policy, and retention policy published on that Provider's official website.

This applies to services including, but not limited to: OpenAI, Anthropic, Google, xAI, Perplexity, Hugging Face, and any other third-party Provider, API, model endpoint, plugin, tool, or external service that you configure or use with PyGPT.

API Keys and Credentials

API keys and other credentials entered into PyGPT are used to authenticate requests to the corresponding Provider or service. They are not intentionally transmitted to the Author.

Your credentials may necessarily be transmitted to the relevant Provider as part of the authentication process when making API requests. You are responsible for protecting your API keys, configuring appropriate usage limits where available, and complying with the Provider's security and account requirements.

Plugins, Tools and Integrations

Some plugins, tools, integrations, web services, or optional App features may communicate with third-party services independently of the selected AI Provider. Data required to perform such operations may therefore be sent to those services.

You should review the privacy policies and terms of any external services that you enable or configure in the App.

Local Models and Services

PyGPT may also be configured to work with locally hosted models or services. When using a fully local configuration, data processing may remain on your local device, depending on the model, software, plugins, tools, and integrations you choose to use.

Contact Form and Enquiries

When you contact us using the contact form, we process the information you provide, such as your name, email address, subject, and message, solely for the purpose of receiving, processing, and responding to your enquiry.
